Terms of Use

Effective Date: July 21, 2026
Last Updated: July 21, 2026

These Website Terms of Use govern your access to and use of the Heirloom Roofing website, including its pages, content, forms, features, calculators, estimate tools, scheduling tools, communications features, and any other services made available through the website.

The website is owned and operated by Heirloom Roofing LLC, an Arizona limited liability company. In these Terms, “Heirloom Roofing,” “Heirloom,” “we,” “us,” and “our” refer to Heirloom Roofing LLC. “You” and “your” refer to each person who accesses or uses the website.

Please read these Terms carefully. By accessing or using the website, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree with these Terms, please discontinue use of the website.

1. Purpose of the Website

The website is provided to introduce Heirloom Roofing, describe the types of roofing services we may offer, provide general roofing information, allow property owners and other visitors to contact us, and facilitate requests for inspections, consultations, estimates, appointments, and other information.

The website is intended for general informational and communication purposes. It is not intended to replace an in-person roof inspection, a property-specific evaluation, professional engineering advice, legal advice, insurance advice, or a written agreement for roofing services.

Accessing the website, submitting a form, requesting information, using an online estimator, communicating with us, or receiving a response from us does not, by itself, create a contractor-client relationship, require Heirloom Roofing to perform services, or obligate either party to enter into a roofing agreement.

2. Separate Roofing Agreements

These Terms apply only to your use of the website.

Any roof inspection, repair, replacement, maintenance service, construction project, emergency service, or other work performed by Heirloom Roofing will be governed by a separate written agreement between Heirloom Roofing and the property owner or other authorized contracting party.

A separate roofing agreement may contain provisions regarding scope of work, pricing, payment, deposits, scheduling, access, warranties, insurance proceeds, supplements, change orders, cancellation, unforeseen conditions, dispute resolution, and other project-specific matters.

If there is a conflict between these Website Terms of Use and a signed roofing agreement, the signed roofing agreement will control with respect to the roofing project or services addressed by that agreement.

Nothing displayed on the website modifies, expands, replaces, or overrides the terms of a signed roofing agreement, manufacturer warranty, workmanship warranty, insurance policy, financing agreement, or other separate written agreement.

3. No Roofing Diagnosis or Inspection Through the Website

Roofing conditions cannot be fully evaluated through photographs, written descriptions, satellite images, aerial measurements, online forms, telephone conversations, videos, or other remote information alone.

Information provided through the website does not constitute:

  • A physical roof inspection;
  • A structural inspection;
  • An engineering evaluation;
  • A moisture assessment;
  • A determination of code compliance;
  • A confirmation that a roof is safe;
  • A determination of the source or extent of a leak;
  • A determination that repair or replacement is required;
  • A certification of remaining roof life;
  • A guarantee that damage is limited to visible areas;
  • A guarantee that a roof is free from defects; or
  • A final recommendation regarding any specific property.

Roofing problems may involve concealed deterioration, trapped moisture, improper prior installation, damaged decking, deteriorated underlayment, flashing defects, drainage problems, structural movement, code issues, hazardous materials, or other conditions that are not visible through remote information.

Property-specific recommendations can be made only after Heirloom Roofing has had an appropriate opportunity to inspect the property and evaluate the relevant conditions.

4. Online Estimates, Calculators, and Pricing Information

The website may include cost ranges, example pricing, online estimates, instant estimates, calculators, measurement tools, financing examples, or other preliminary pricing information.

Any such information is provided for general planning and informational purposes only. It is not a binding proposal, final price, guaranteed price, offer to perform work, or promise that a project can be completed for the amount displayed.

Online estimates may be based on information that includes:

  • Details submitted by the website visitor;
  • Public property records;
  • Satellite or aerial imagery;
  • Automated roof measurements;
  • Third-party measurement reports;
  • General assumptions regarding roof size and complexity;
  • Typical material and labor costs;
  • Assumptions regarding access, tear-off, disposal, and existing conditions; and
  • Information that may be incomplete, outdated, estimated, or inaccurate.

An online estimate may not account for roof pitch, number of layers, damaged decking, underlayment condition, flashing requirements, structural conditions, code requirements, access limitations, occupied areas, solar equipment, mechanical equipment, specialty materials, discontinued products, hazardous materials, permit requirements, hidden damage, unusual disposal costs, or other property-specific conditions.

Final scope and pricing will be established only through a written proposal or agreement issued or approved by Heirloom Roofing after an appropriate evaluation of the property.

Heirloom Roofing may correct, withdraw, or revise preliminary pricing at any time before a written agreement is signed.

5. Requests for Inspections, Consultations, and Appointments

The website may allow you to request an inspection, consultation, appointment, estimate, or telephone call. Submitting a request does not guarantee availability, acceptance, scheduling, service, or a response within any particular period.

An appointment is not confirmed unless Heirloom Roofing expressly confirms it.

We may decline a request for any lawful reason, including service-area limitations, licensing limitations, project type, scheduling constraints, roof accessibility, safety concerns, property conditions, incomplete information, conflicts of interest, or inability to reach the person submitting the request.

You represent that the information you submit is accurate and that you are the property owner or otherwise authorized to request contact or services concerning the property identified in your submission.

6. Emergency Conditions

Website forms, email messages, online chats, social-media messages, and estimate requests should not be used to report an immediate threat to life, safety, or property.

Website submissions are not monitored continuously, and Heirloom Roofing does not guarantee an immediate response.

If there is an active fire, electrical hazard, structural collapse, gas leak, medical emergency, or other immediate danger, contact the appropriate emergency service provider.

Do not enter an unsafe area, walk on a damaged roof, climb a ladder, touch downed electrical equipment, or attempt repairs that may place you or another person at risk.

References on the website to emergency services, rapid response, after-hours assistance, or 24-hour availability do not guarantee that personnel, materials, equipment, temporary repairs, or permanent repairs will be immediately available in every location or circumstance.

Response times may be affected by weather, widespread storm events, road conditions, safety concerns, material availability, crew availability, property access, and the volume of requests received.

7. Roofing and Educational Content

The website may contain articles, guides, frequently asked questions, cost discussions, maintenance information, storm information, insurance-related information, material comparisons, service descriptions, and other educational content.

This content is general in nature and may not apply to your property, roof system, insurance policy, municipality, association, warranty, or circumstances.

Roofing practices, building codes, manufacturer requirements, insurance procedures, material availability, pricing, and industry standards may change. Although we may update website content, we do not guarantee that every page will always reflect the most recent information.

You should not make a roofing, financial, insurance, legal, safety, or construction decision solely on the basis of general website content.

8. Insurance-Related Information

Heirloom Roofing may provide general information concerning storm damage, insurance restoration, claim documentation, estimates, scopes of loss, recoverable depreciation, supplements, deductibles, and the repair or replacement process.

Unless expressly stated otherwise in writing, Heirloom Roofing acts as a roofing contractor and does not act as your insurance company, insurance agent, attorney, engineer, or public adjuster.

Nothing on the website constitutes legal advice, insurance coverage advice, claim representation, or a promise that an insurance carrier will approve or pay for any repair, replacement, supplement, upgrade, code item, or other amount.

Insurance coverage decisions are made by the applicable insurance carrier under the language of the insurance policy and the facts of the claim.

Any references to insurance proceeds, claim payments, deductibles, supplements, depreciation, or coverage are general descriptions only. Property owners remain responsible for understanding their policies, communicating with their insurers, and paying any amounts required under their agreements with Heirloom Roofing.

Heirloom Roofing does not guarantee the outcome, value, timing, or payment of an insurance claim.

9. Photographs, Renderings, Colors, and Project Examples

The website may display photographs, videos, illustrations, digital renderings, material samples, completed projects, homes, buildings, roof systems, colors, textures, and design examples.

These materials are provided for illustration and inspiration. They do not guarantee that the same products, colors, finishes, details, conditions, appearance, or results will be available or achieved on another property.

Colors and textures may appear differently depending on lighting, weather, manufacturing variation, photography, editing, screen settings, printing, age, surrounding materials, and installation conditions.

Visitors should review current physical samples, manufacturer information, product specifications, and project-specific documentation before making a final selection.

Unless expressly identified as an actual Heirloom Roofing project, an image may be representative, licensed, digitally created, supplied by a manufacturer, or used to illustrate a general architectural or roofing concept.

Project results vary based on the property, roof design, existing conditions, selected materials, construction limitations, and other factors.

10. Manufacturer Information and Warranties

The website may reference roofing products, manufacturers, product specifications, certifications, ratings, installation methods, expected service life, or warranty programs.

Manufacturer names, trademarks, product descriptions, warranty summaries, and specifications belong to their respective owners and may be changed by the manufacturer without notice.

Website summaries are not substitutes for current manufacturer specifications, installation instructions, eligibility requirements, exclusions, registration requirements, or written warranty documents.

No statement on the website creates a manufacturer warranty or changes the terms of any manufacturer warranty.

Eligibility for a warranty may depend on the selected system, installation method, building type, ventilation, deck condition, registration, maintenance, contractor status, geographic area, or other requirements established by the manufacturer.

11. Service Areas and Licensing

The website may be accessible from locations where Heirloom Roofing does not provide services.

Access to the website from a particular location does not represent that Heirloom Roofing is licensed, available, or offering to perform work in that location.

Services are offered only where Heirloom Roofing is properly authorized to provide them and where we elect to accept the project.

Service areas, office locations, availability, and the types of projects accepted may change without notice.

12. Accuracy of Website Information

Heirloom Roofing makes reasonable efforts to present useful and accurate information. However, website content may occasionally contain typographical errors, incomplete descriptions, outdated information, broken links, technical errors, inaccurate measurements, pricing errors, or other mistakes.

We do not warrant that all website content is complete, current, accurate, or suitable for every purpose.

We may correct errors, revise content, modify services, update pricing, remove pages, change features, or discontinue portions of the website at any time without prior notice.

The presence of outdated or incomplete information does not obligate Heirloom Roofing to provide a product, service, price, warranty, response time, or project term previously described on the website.

13. Acceptable Use

You may use the website only for lawful, personal, and legitimate business purposes consistent with these Terms.

You may not:

  • Use the website in violation of any law or regulation;
  • Submit false, misleading, fraudulent, or impersonated information;
  • Misrepresent your identity, authority, ownership, or relationship to a property;
  • Attempt to gain unauthorized access to the website, server, database, account, form, or connected system;
  • Interfere with the operation, security, speed, availability, or integrity of the website;
  • Introduce malware, viruses, ransomware, corrupted files, malicious code, or harmful technology;
  • Probe, scan, test, or circumvent website security;
  • Use automated systems to overload, disrupt, or repeatedly submit requests through the website;
  • Scrape, harvest, copy, download, index, or extract website content through automated means without written permission;
  • Use bots, crawlers, scripts, data-mining tools, or similar technology except as expressly authorized by us or used by ordinary public search engines;
  • Copy the website’s design, layout, visual identity, written content, images, videos, or proprietary materials;
  • Frame, mirror, reproduce, republish, or create a substitute for the website;
  • Use website content to create a competing website, marketing campaign, roofing company identity, estimate system, or commercial product;
  • Use website content, photographs, branding, or copy to train, develop, test, or improve an artificial-intelligence or machine-learning system without prior written permission;
  • Remove copyright, trademark, authorship, attribution, or proprietary notices;
  • Submit spam, unsolicited promotions, abusive content, unlawful content, or repeated communications;
  • Use the website to harass, threaten, defame, deceive, or harm another person;
  • Submit information concerning a property when you lack a lawful or legitimate reason to do so; or
  • Assist another person in engaging in prohibited conduct.

Heirloom Roofing may restrict or block access to the website when we reasonably believe these Terms have been violated or the website is being misused.

14. Intellectual Property

The website and its contents are owned by, licensed to, or used with permission by Heirloom Roofing.

Protected materials may include:

  • The Heirloom Roofing name;
  • Logos, marks, icons, and visual identity;
  • The “Roofing Refined” tagline and other brand language;
  • Website copy and service descriptions;
  • Articles, guides, and educational content;
  • Photographs, videos, graphics, renderings, and illustrations;
  • Page layouts and design elements;
  • Downloadable materials;
  • Forms, questionnaires, and workflows;
  • Estimate presentations and information architecture;
  • Original diagrams, charts, and written explanations; and
  • The selection, arrangement, and presentation of website content.

These materials are protected by applicable copyright, trademark, unfair-competition, and other intellectual-property laws.

Heirloom Roofing grants you a limited, revocable, nonexclusive, nontransferable license to access and use the website for your own lawful, noncommercial evaluation of Heirloom Roofing and its services.

No ownership rights are transferred to you.

Except as expressly permitted by law or authorized in writing by Heirloom Roofing, you may not reproduce, distribute, modify, publish, display, transmit, sell, license, create derivative works from, or commercially exploit website content.

15. Permitted Sharing and Linking

You may share a standard link to a public page of the website, provided that the link:

  • Is used lawfully;
  • Does not misrepresent your relationship with Heirloom Roofing;
  • Does not imply sponsorship, approval, partnership, or endorsement;
  • Does not appear in connection with unlawful, deceptive, defamatory, or inappropriate content; and
  • Does not frame or reproduce the website within another website or application.

We may withdraw linking permission at any time.

Permission to link to the website does not grant permission to copy website content, photographs, graphics, logos, articles, or branded materials.

16. Information You Submit

When you submit information through the website, you represent that:

  • The information is accurate to the best of your knowledge;
  • You have the lawful right to provide it;
  • You are not impersonating another person;
  • Your submission does not violate another person’s privacy or intellectual-property rights;
  • Your submission does not contain malware or unlawful material; and
  • You are authorized to request contact concerning any property, project, company, or association identified in the submission.

Information submitted through contact forms, estimate forms, scheduling tools, employment forms, or other website features may be used to respond to your request, assess potential services, schedule communications, maintain business records, improve our services, prevent fraud, and carry out other purposes described in our Privacy Policy.

Please do not submit highly sensitive information through ordinary website forms, including Social Security numbers, complete financial-account numbers, passwords, medical records, or other information that is not reasonably necessary for your request.

17. Photographs and Documents Submitted by Visitors

You may have the ability to submit photographs, videos, measurements, insurance documents, reports, property information, or other materials.

You retain ownership of materials you lawfully own. By submitting them to us, you grant Heirloom Roofing a nonexclusive permission to review, copy, store, transmit, and use the materials to evaluate your request, communicate with you, prepare an inspection or estimate, coordinate services, document a potential or active project, and maintain appropriate business records.

This permission does not authorize Heirloom Roofing to use identifiable photographs of your property for public advertising without separate permission, except where the material has already been made publicly available by you or may otherwise lawfully be used.

You are responsible for removing or redacting information that is unrelated to the purpose of your submission.

Do not submit documents or images that you are not authorized to provide.

18. Testimonials, Reviews, and Voluntary Content

If you voluntarily provide a testimonial, project statement, photograph, video, comment, or other material directly to Heirloom Roofing for potential promotional use, you grant us a nonexclusive, worldwide, royalty-free permission to reproduce, edit for length or clarity, publish, display, and distribute that material in connection with our business and marketing.

We will not intentionally alter a testimonial in a manner that materially misrepresents the reviewer’s experience.

Nothing in these Terms prevents or restricts you from providing an honest review, assessment, or opinion about Heirloom Roofing, its services, or your experience.

The promotional permission in this section does not transfer ownership of an independently posted consumer review to Heirloom Roofing.

19. Electronic Communications

When you contact us electronically, submit a website form, or provide an email address, you consent to receive communications relating to your request through electronic means.

Electronic communications may include appointment confirmations, estimate information, requested documents, project-related notices, responses to questions, and other communications connected to your inquiry or relationship with Heirloom Roofing.

You are responsible for providing accurate contact information and maintaining access to the email account or telephone number you provide.

Electronic delivery does not necessarily mean that every legally required project notice will be delivered electronically. The method of delivery for notices relating to an active roofing project may be governed by the applicable written roofing agreement and law.

20. Telephone Calls and Text Messages

When you provide a telephone number and expressly request or consent to telephone or text communication, Heirloom Roofing may contact you regarding your inquiry, requested inspection, appointment, estimate, potential project, active project, or related services.

Depending on the consent you provide, communications may be made using manual dialing, automated technology, prerecorded or artificial voice, or an automated text-messaging system.

Consent to receive marketing calls or text messages is not a condition of purchasing roofing services.

Message frequency may vary. Message and data rates may apply.

You may request that text messages stop by replying STOP. You may request assistance by replying HELP or contacting Heirloom Roofing directly.

A request to stop marketing communications will not prevent Heirloom Roofing from sending communications that are legally permitted or reasonably necessary to complete an existing transaction, respond to a new request initiated by you, provide safety information, administer an active project, or comply with law.

Mobile carriers are not responsible for delayed or undelivered messages.

The specific disclosure presented at the point where you provide your telephone number will control if it provides more detailed or more protective terms than this section.

21. Email Communications

You may receive emails that you request, as well as emails relating to an inspection, estimate, appointment, project, inquiry, or existing business relationship.

Where required, promotional emails will include a method for unsubscribing. You may also contact us directly to request that promotional emails stop.

An unsubscribe request may not prevent transactional or project-related communications, such as responses to a request you initiated, appointment information, contract communications, invoices, warranty information, or notices concerning an active project.

22. Privacy

Your use of the website is also subject to the Heirloom Roofing Privacy Policy.

The Privacy Policy describes the categories of information we may collect, how information may be used, when it may be shared, and choices that may be available to website visitors.

These Terms and the Privacy Policy should be read together. If a provision of these Terms directly conflicts with the Privacy Policy regarding the handling of personal information, the Privacy Policy will control as to that issue.

23. Third-Party Tools and Services

The website may contain or connect with tools and services provided by third parties.

These may include:

  • Online estimate tools;
  • Aerial measurement or property-data services;
  • Scheduling tools;
  • Customer relationship management systems;
  • Financing platforms;
  • Payment processors;
  • Mapping services;
  • Analytics providers;
  • Website hosting and security providers;
  • Review platforms;
  • Social-media platforms;
  • Video services;
  • Chat or messaging tools;
  • Manufacturer websites;
  • Insurance-related resources; and
  • Other embedded or linked services.

Third-party tools may collect information directly from you and may operate under their own terms and privacy policies.

Heirloom Roofing does not control every aspect of a third-party service and is not responsible for the independent acts, omissions, availability, security, accuracy, content, or privacy practices of third-party providers.

The inclusion of a third-party link, logo, service, or integration does not necessarily constitute an endorsement, warranty, partnership, or guarantee.

You are responsible for reviewing the terms and privacy practices of any third-party service you choose to use.

24. Financing Information

The website may include general information concerning financing or links to third-party financing providers.

Heirloom Roofing is not a lender and does not guarantee financing approval, interest rates, credit limits, payment amounts, promotional terms, or the availability of a particular financing program.

Financing decisions are made by the applicable third-party provider according to its own eligibility requirements and agreements.

Displayed financing examples are illustrative unless expressly stated otherwise. Actual terms may depend on creditworthiness, project amount, lender approval, program availability, and other factors.

A financing agreement is separate from any agreement for roofing services.

25. Third-Party Websites

The website may link to websites operated by manufacturers, government agencies, professional organizations, social-media companies, insurers, financing providers, review platforms, or other third parties.

Heirloom Roofing provides these links for convenience or reference. We do not control and are not responsible for third-party website content, availability, security, accuracy, policies, products, or services.

Visiting a third-party website is at your discretion and subject to that website’s own terms and policies.

26. Website Availability and Security

We may maintain, modify, suspend, restrict, or discontinue the website or any feature at any time.

We do not guarantee that the website will be:

  • Available continuously;
  • Free from interruptions or delays;
  • Compatible with every device or browser;
  • Free from technical defects;
  • Free from malicious code introduced by third parties;
  • Secure against every unauthorized attempt; or
  • Capable of preserving every submission or communication.

You are responsible for maintaining reasonable security measures on your own devices, accounts, networks, and software.

You should retain copies of important communications and documents rather than relying on the website as a permanent storage system.

27. No Warranties Regarding the Website

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis.

Heirloom Roofing disclaims warranties relating to the website, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security.

This website disclaimer applies to the website itself and does not eliminate or modify any express workmanship warranty, manufacturer warranty, or other obligation contained in a separate signed roofing agreement.

Some jurisdictions do not permit certain warranty disclaimers. Where a disclaimer is not permitted, it will apply only to the maximum extent allowed by law.

28. Limitation of Liability

To the fullest extent permitted by law, Heirloom Roofing and its members, managers, officers, employees, representatives, contractors, service providers, licensors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:

  • Access to or use of the website;
  • Inability to access or use the website;
  • Reliance on general website content;
  • An incomplete, delayed, or unsuccessful website submission;
  • Errors in an online estimate or calculation;
  • Unauthorized access to information;
  • Third-party websites, services, or tools;
  • Website interruptions, technical errors, or malicious code; or
  • Decisions made without a property-specific inspection or written agreement.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

This limitation concerns website use. Liability relating to roofing work performed under a signed agreement will be governed by that agreement and applicable law.

29. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Heirloom Roofing and its members, managers, officers, employees, representatives, contractors, service providers, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the website;
  • Information or materials you submit;
  • Your violation of these Terms;
  • Your violation of another person’s privacy, intellectual-property, or other legal rights;
  • Your misrepresentation of your identity, authority, or relationship to a property; or
  • Malicious, fraudulent, or abusive conduct involving the website.

This provision does not require a consumer to indemnify Heirloom Roofing for Heirloom Roofing’s own unlawful conduct or for obligations that cannot lawfully be transferred.

30. Copyright Concerns

Heirloom Roofing respects intellectual-property rights.

If you believe material displayed on the website infringes a copyright or other intellectual-property right, please provide a written notice containing sufficient information for us to identify the material, understand the basis of the concern, and contact you.

Notices may be sent to:

Heirloom Roofing LLC
Attn: Website and Intellectual Property
4700 E Thomas Road, Suite 104
Phoenix, Arizona 85018
Email: info@heirloomroofing.com

Submitting a knowingly false infringement notice may have legal consequences.

31. Accessibility

Heirloom Roofing seeks to provide a useful website experience for visitors.

If you experience difficulty accessing website content or using a website feature, please contact us and identify the page or feature involved. We will make reasonable efforts to provide the requested information through an appropriate alternative method.

Accessibility requests may be submitted through:

Telephone: 602-456-2787
Email: info@heirloomroofing.com

An accessibility request is separate from an emergency roofing request and may not receive an immediate response outside ordinary business operations.

32. Children’s Use

The website is intended for property owners, property representatives, business professionals, and other persons seeking information about roofing services.

It is not directed to children under 13, and children under 13 should not submit personal information through the website.

If we learn that personal information was submitted by a child in a manner requiring deletion under applicable law, we will take reasonable steps to address it.

33. Suspension or Restriction of Access

Heirloom Roofing may suspend, restrict, or terminate access to the website or its features if we reasonably believe that a person:

  • Has violated these Terms;
  • Has attempted unauthorized access;
  • Has submitted fraudulent or abusive requests;
  • Has interfered with website operation;
  • Presents a security concern;
  • Has used automated systems without authorization; or
  • Has engaged in conduct that may harm Heirloom Roofing, another person, or the website.

Restriction of website access does not affect rights or obligations arising under a separate signed roofing agreement.

34. Changes to These Terms

We may revise these Terms from time to time to reflect changes in the website, our practices, available services, legal requirements, or business operations.

The revised version will be posted with an updated “Last Updated” date.

Unless otherwise stated, revised Terms apply when posted. Changes will not retroactively alter the express terms of a roofing agreement that was previously signed.

Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

35. Governing Law

These Terms and disputes arising specifically from website access or use will be governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

36. Informal Resolution of Website Disputes

Before filing a lawsuit concerning website use, the parties are encouraged to make a good-faith effort to resolve the issue informally.

A written notice should briefly describe the issue, the relevant circumstances, and the requested resolution.

Notices to Heirloom Roofing may be sent to:

Heirloom Roofing LLC
Attn: Website Terms
4700 E Thomas Road, Suite 104
Phoenix, Arizona 85018
Email: info@heirloomroofing.com

This informal process does not prevent either party from seeking urgent relief when reasonably necessary to protect safety, property, confidential information, or intellectual-property rights.

37. Jurisdiction and Venue

Subject to applicable law and any controlling provision in a separate signed agreement, a legal action arising solely from these Website Terms of Use will be brought in a state or federal court having jurisdiction in Maricopa County, Arizona.

Nothing in this section prevents a consumer from exercising a right that cannot lawfully be waived or restricted.

38. No Waiver

A failure by Heirloom Roofing to enforce a provision of these Terms does not waive that provision or the right to enforce it later.

A waiver is effective only if it is expressly made in writing by an authorized representative of Heirloom Roofing.

39. Severability

If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or modified only as necessary to make it enforceable.

The remaining provisions will continue in effect.

40. Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent from Heirloom Roofing.

Heirloom Roofing may assign these Terms in connection with a merger, reorganization, sale of assets, financing transaction, change in ownership, or transfer of website operations, subject to applicable law.

41. Headings

Section headings are included for convenience and organization. They do not limit or alter the meaning of the provisions.

42. Entire Agreement Regarding Website Use

These Terms, together with the Privacy Policy and any additional notice presented through a particular website feature, constitute the entire understanding between you and Heirloom Roofing regarding use of the website.

They do not replace or amend a separately signed roofing agreement, financing agreement, manufacturer warranty, employment agreement, subcontractor agreement, vendor agreement, or other written contract.

43. Contact Information

Questions concerning these Website Terms of Use may be directed to:

Heirloom Roofing LLC
4700 E Thomas Road, Suite 104
Phoenix, Arizona 85018

Telephone: 602-456-2787
Email: info@heirloomroofing.com

The SMS section should remain only if your website forms include a separate, clear consent disclosure near the telephone field or submission button. Current FCC guidance distinguishes marketing texts and requires appropriate consent while preserving a consumer’s ability to revoke it; simply burying consent inside footer terms is not enough. (Federal Communications Commission)

I also intentionally preserved customers’ right to leave honest reviews because the FTC states that standardized terms cannot prohibit, penalize, or seize ownership of honest consumer reviews. (Federal Trade Commission) Arizona recognizes electronic records and contracts, but important acceptance language should still be conspicuous near forms rather than relying entirely on a footer link. (Arizona Legislature)

This is a strong publishing draft, but an Arizona business attorney should review it alongside your Privacy Policy, form consent language, and actual website tools before it goes live.
